Privacy Policy
Last updated: October 2026
1. Who we are
This privacy policy applies to the website at www.brandnew.ie (the "Website"), operated by Brand New Creative Limited, trading as BrandNew Creative ("we", "us", "our"). We are a private company registered in Ireland (company number 549138). Our registered office and our studio is at 61 Merrion Square South, Dublin 2, D02 EW25.
We are the data controller for the personal data described in this policy. If you have any questions about how we handle your data, contact us at studio@brandnew.ie or write to us at the studio address above.
We process personal data in line with the General Data Protection Regulation (GDPR), the Data Protection Act 2018 and the ePrivacy Regulations 2011.
2. What personal data we collect
We only collect personal data that you give us or that is generated when you use the Website.
Contact and enquiry forms. Your name, email address, phone number, company name and anything you include in your message.
Newsletter sign-up. Your name and email address, plus a record of when and how you subscribed.
Email and other correspondence. Anything you send us when you get in touch directly.
Website usage data. Information about how visitors use the Website, such as pages visited, time on page, approximate location (country or city), device and browser type, and how you arrived at the site. This is collected through analytics cookies only if you accept them. IP addresses are truncated or anonymised by our analytics provider before being stored. See our Cookies Policy for details.
Recruitment. If you apply for a role or placement with us, your CV, cover letter and any information you provide during the process.
Client data. If you become a client, we hold your business contact details and the information needed to deliver our services. This is governed by our client agreement rather than this policy.
We do not knowingly collect data from anyone under 16, and the Website is not aimed at children.
3. How we use your data and our legal basis
GDPR requires us to have a lawful basis for each way we use your personal data. These are set out below.
We do not use your data for automated decision-making or profiling that has a legal or similarly significant effect on you.
4. Who we share your data with
We never sell personal data. We share it only with:
• Website hosting provider – Blacknight – hosts the Website and the data submitted through it.
• Forms provider (Framer) – processes contact form submissions and delivers them to us.
• Newsletter provider (ActiveCampaign) – stores subscriber details and sends our newsletter.
• Analytics provider (Google Analytics 4) – collects website usage data if you accept analytics cookies.
• Our professional advisers, such as accountants, solicitors and insurers, where necessary.
• Regulators, courts or law enforcement where we are legally required to.
• A buyer or prospective buyer if we sell or restructure the business, on terms that keep your data protected.
Each service provider acts under a contract that limits them to processing your data on our instructions and keeping it secure.
5. Where your data is stored and international transfers
We aim to keep personal data within the European Economic Area (EEA). Some of the providers above may store or process data in the United States or elsewhere outside the EEA. Where that happens, we rely on one of the safeguards recognised under GDPR: an EU adequacy decision (including the EU-US Data Privacy Framework for certified US companies) or the European Commission's Standard Contractual Clauses. You can ask us for details of the safeguard that applies.

• Have inaccurate data corrected.
• Have your data erased, where there is no good reason for us to keep it.
• Restrict how we use your data in certain circumstances.
• Object to processing based on legitimate interests, including direct marketing.
• Receive your data in a portable format where processing is based on consent or contract.

If you are unhappy with how we have handled your data, you can complain to the Data Protection Commission, 6 Pembroke Row, Dublin 2, D02 X963, or at www.dataprotection.ie. We would appreciate the chance to resolve the issue with you first.

We use appropriate technical and organisational measures to protect personal data, including secure hosting, access controls and encrypted connections (HTTPS). No transmission over the internet is completely secure, so we cannot guarantee the security of data in transit to the Website.
